In the health industry of United States of America, the use of Electronic Health Records is a widespread practice. Through Health Information Technology for Economic and Clinical Health Act (HITECH), the US Government is encouraging even small scale health practices and clinics to adopt Electronic Health Record system. The objective is to revolutionize the health industry by creating a nation-wide system of Electronic Health Records.

HITECH’s goal is not mere adoption, but “meaningful use” of EHRs – that is to use the EHR Software to achieve considerable improvements in quality of health care. Any achievement in this regard is financially rewarded by the legislation. HITECH invites the entire health industry for public and professional inputs to formulate specific “meaningful use” objectives. The department has already published meaningful use requirements in the year 2010. The diverse range of stakeholders involved can always contribute their ideas, comments and suggestions intended to improve the final regulation.

The most significant part of this regulation is that hospitals and clinics must adopt EHRs in a way that they are considered “meaningful users”. Hence, some essential activities have been formulated by the regulatory authorities from which services providers will choose to implement in a certain period of time. As a starting point of adopting “meaningful use” of EHR Software, those tasks are performed that are needed to create an effective Electronic Health Record; for example basic data entry of patients’ demographics. The second stage is about using several software applications to improve quality, safety and efficiency of care. Meaningful use overview will also include extending the benefits of EHR use to patients.

To qualify for incentives, clinicians will opt for decision support systems which will allow them to apply logic on recorded patient data. For example, incorporating clinical lab results into EHRs, appointment reminders for patients, patient-specific health education etc. Clinicians will have to report data on key measures such as blood-pressure, tobacco status etc. and later their performance will be evaluated on various scales and communicated to the service provider and also the public.

To give a brief meaningful use overview, the regulations intends to strike a balance between the urgency of adopting Electronic Health Record systems and the challenges that the EHR users will face along the way. The “meaningful use” ruling has to be ambitious, yet achievable. Its success is possible if the entire stakeholders involved in the process are harmonized, keeping in account complex real-world scenarios and technology limitations.

A buyer’s failure to object to terms contained within a shrink-wrapped software package may constitute an acceptance of the terms – “it’s yours…you opened it, you keep it” – by conduct. This responsibility is supported and enforceable, according to section-2 of the Uniform Commercial Code (UCC), the law governing sales contracts provides that any contract for the sale of goods “may be made in any manner sufficient to show (agreement of/to terms offered) agreement, including conduct by both parties which recognizes the existence of a specified contract.”

Offerees, vendors, merchants, and/or sellers who do business via the Internet can protect themselves against contract disputes and legal liability by creating offers that spell out clearly the terms that will govern their transactions. Should offers be accepted, important terms should always (or otherwise) be conspicuous and easily viewed by online buyers.
